Terms of Use & End User License Agreement

These Terms of Use ("Terms" or "EULA") govern your use of the Tomodachi Miis app ("the App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms and these Terms.

2. User-Generated Content

The App lets users submit content (Mii images, names, descriptions, and tags). You are solely responsible for the content you submit and must have the rights to share it. You retain ownership of your content and grant us a license to host, display, and distribute it within the App.

3. Zero Tolerance for Objectionable Content and Abusive Behavior

There is no tolerance for objectionable content or abusive users. You agree not to submit content that is, and not to behave in ways that are:

Offensive, harassing, threatening, hateful, or discriminatory;
Sexually explicit, violent, or otherwise inappropriate;
Infringing on the intellectual property or other rights of any third party;
Spam, fraudulent, or misleading.

4. Moderation & Pre-Publication Review

Content submitted through the App is reviewed before it becomes visible to other users in the App. We may filter, reject, remove, or hide any content at our discretion. We use both automated filtering and human review.

5. Reporting & Enforcement

You can report objectionable content from any Mii's detail screen, and you can block a creator so you no longer see their content. We act on reports of objectionable content and remove offending content within 24 hours. We may suspend or terminate accounts of users who violate these Terms, including ejecting repeat or abusive offenders.

6. Account Termination & Deletion

You may delete your account and content at any time by emailing tomo-support@ideogram-4.com. We may suspend or terminate accounts that violate these Terms.

7. Disclaimers & Limitation of Liability

The App is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App.

8. Apple

This EULA is between you and us only, not with Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

9. Changes

We may update these Terms; continued use of the App after changes constitutes acceptance.
